Service Agreements

This service agreement for LAWN MOWING MAINTENANCE between the service provider (KEVIN J SERVICS LLC) and the CUSTOMER, begins on acceptance of the quote and continues month-to-month each season, every calendar year. A season runs from April 1st -October 30th each calendar year. 

(A1) KEVIN J SERVICES LLC or the CUSTOMER may cancel this service agreement anytime via written (email) notice, and the cancellation is valid upon the written (email) acknowledgment of the requested cancellation.

(A2) If the CUSTOMER is on a month-to-month payment plan and cancels this agreement and receives confirmation that KEVIN J SERVICS LLC acknowledges their request, the customer will incur no further charges, and the account will go inactive. NO REFUNDS will be given for past skipped services or for the month in which they canceled if any one service has already been rendered. 

(A3) If the CUSTOMER pre-paid for the season NO REFUNDS will be given for past skipped services or for the month in which they canceled. However, the CUSTOMER will incur a $70 cancellation fee per month on what is remaining. The CUSTOMER understands that any refunds are currently via check and may take up to 14 days to deliver.

(B1) KEVIN J SERVICES LLC agrees to send a seasonal renewal reminder email invoice every February with updated pricing and another reminder email in March. The CUSTOMER can notify KEVIN J SERVICES to also have such renewal reminders sent via SMS to their cell phone number on file.

(B2) The CUSTOMER may use the months of November, December, January, February, and March to request a switch from month-to-month payments or full-season payments and vice versa before a new season begins.

(B3) The 5% discount for full-season payments is only valid for payments made by April 1st each season. The CUSTOMER can opt to pay for spring cleanups, fall cleanups, or other services on the same April 1st invoice to save 5% on these additional services. 

(C1) The CUSTOMER is responsible for reviewing all invoices for accuracy before payments are made and/or emails that may notify the CUSTOMER of updates on our service agreements.

(C2) The CUSTOMER will be notified of any changes to our service agreements and updated service agreements can be found on our website. The Customer will not need to approve a new service agreement if changes are made but should contact KEVIN J SERVICES LLC to opt out of any changes and cancel their service agreement.

(D) KEVIN J SERVICES LLC and the CUSTOMER understand that the Lawn Mowing Maintenance service includes:

(D1) Mowing the lawn by mulching grass clippings back onto the lawn using a gas-powered lawn mower, with a cutting height of 3.5 - 4.0 inches. 

(D2) String trimming areas of lawn turf where the mower blades can not reach.

(D3) Maintaining an already established edge where the concrete meets the lawn turf except where asphalt is present. 

(D4) Blowing grass clippings that may have fallen onto paved areas back onto the lawn to provide the lawn with additional natural nutrients.

(E) The CUSTOMER understands the following: 

(E1) KEVIN J SERVICES LLC does NOT cut lower than 3.5 inches except in October when KEVIN J SERVICS LLC lowers the height gradually to 2.5 - 3 inches, and patience is needed during the spring-heavy-growth season, and cutting the grass lower than 3.5 inches is not optional even during this time.

 (E2) String trimming does NOT include cracks in sidewalks or driveways, flower beds, and under or above steps, patios, and decks. The CUSTOMER should seek weed control methods or services for such areas.

(E3) A 1-time EDGE ESTABLISHMENT FEE will be charged on the first invoice of every season.

(F1) This is a pre-paid service, monthly on the 1st of every month or for the full season, and monthly plans require a valid credit/debit card on file using a secure online link we provide through YARDBOOK. YARDBOOK uses STRIPE for secure payment processing.

(F2) The Customer is NOT PAYING for a set number of services per month or season, but for monthly ongoing lawn mowing maintenance, and KEVIN J SERVICS LLC determines the day and times the lawn will be serviced, and such days and times are subject to change anytime, although KEVIN J SERVICS LLC will attempt to be as consistent as possible from week-to-week. 

(F3) For full season payment CUSTOMERS, every calendar year, KEVIN J SERVICS LLC  will invoice, and charge the card on file, on April 1st, and the first invoice will include an edge establishment fee and any agreed spring/lawn cleanup fees. Scheduling of the weekly lawn mowing maintenance services will be done after payment confirmation is received, and the first service date is determined by KEVIN J SERVICES LLC.
 
(F4) For month-to-month payment CUSTOMERS, every calendar year, KEVIN J SERVICS LLC  will invoice, and charge the card on file, on April 1st, May 1st, June 1st, July 1st, August 1st, September 1st, October 1st and the first invoice will include an edge establishment fee and any agreed spring/lawn cleanup fees. Scheduling of the weekly lawn mowing maintenance services will be done after payment confirmation is received, and the first service date is determined by KEVIN J SERVICES LLC.

(F5) KEVIN J SERVICES LLC will not begin mowing the property(s) if there are leaves, twigs, branches, trash, or other debris left on the lawn from winter, low branches hanging from trees, REGARDLESS of whether the customer has already paid for lawnmowing maintenance. The CUSTOMER should let us know before accepting this agreement of the need for a spring cleanup, hire someone to do a spring cleanup or complete the spring cleanup themselves beforehand.

(G1) Wet grass from rain or sprinkler systems, droughts, dangerous heat temperatures, equipment issues, safety issues (such as loose pets or visible violent weapons), construction or home maintenance, or other circumstances that hinder KEVIN J SERVICS LLC from providing services may cause the scheduled service to be skipped that day and KEVIN J SERVICS LLC will attempt to make up for the skipped service within three (3) business days. If this fails KEVIN J SERVICS LLC will attempt to make up the previously skipped services by flexing the upcoming week's schedule or in November if forecasted temperatures are steadily above 50 degrees. If that fails and this is the second season or more in a row that the CUSTOMER  has placed a lawn mowing maintenance agreement with KEVIN J SERVICS LLC, the CUSTOMER may receive multiple visits per week from KEVIN J SERVICS LLC during the following spring peek growing season at no extra charge to make up for the previously skipped services during the season before, however, under any circumstance, KEVIN J SERVICS LLC is not obligated to make up previously skipped services at all. 

(G2) THERE ARE NO REFUNDS FOR SKIPPED SERVICES as the CUSTOMER understands that they are NOT PAYING for a set number of services per month or season but for monthly ongoing lawn mowing maintenance.

(H1) KEVIN J SERVICES LLC has the right to charge future invoice fees for the following: (1) EXCESSIVE PET WASTE $15 - charged when pet waste gets on equipment or employees' clothing and is deemed to be due to neglect (2) EXCESSIVE TOY/DEBRIS PICKUP $10 - charged when we have to stop the mower or other equipment to pick up or move items in the service area (3) RETURN FOR SERVICE $10 - charged when we have to leave and return later due to parking issues, locked gates, cars in the driveway we can't get around, construction or maintenance at a property we weren't forewarned of, etc  (4) ADDED LANDSCAPE - charged when the customer adds landscape to property after accepting quote including but not limited to swing-sets, fire-pits, trampolines, trees in the middle of the yard, flower beds, etc.

(H2) KEVIN J SERVICES LLC does not move trampolines, patio furniture, or other landscaping items to service the property that could risk causing even the smallest injury to employees.

Prior to performing any lawn maintenance, the CUSTOMER understands KEVIN J SERVICES must establish an edge for the new season.

The edge establishment is a one-time fee of $60 and maintaining the edge afterward is included in the Lawn Mowing Maintenance service agreement according to the terms set forth in that agreement.

The CUSTOMER understands that KEVIN J SERVICES will not begin mowing the lawn if a spring spruce-up is needed, regardless if the customer has been charged with their fist month of lawn maintenance.

if the lawn has leaves, twigs, branches, trash, or other debris on the lawn, it is the CUSTOMER'S responsibility to hire KEVIN J SERVICES, hire another business, or perform the spring spruce-up themselves.
